Present: Mayor Trinks, Deputy Mayor Curtis, Councilor
Broxterman, Councilor Ellingwood, Councilor Dean,
Councilor Jepsen, Councilor Mulligan, Councilor Simon
and Councilor Walker
Mayor Trinks called the Special Meeting to order at
7:06 p.m.
Mayor Trinks said the Town Attorney looked into this
and the only way to stop a meeting was to have a meeting
prior rescinding the calling of the September 7, 2004
Special Town Meeting.
Acting Town Manager Peter Souza said that there were
a number of concerns from veterans concerning the
cemetery. At the current annual burial rate, there could
be 13-15 years of space left. Discussions will be
initiated and completed with recommendations coming back
to Council at a later date.
Councilor Jepsen is curious about the mechanism with
which to rescind the call. It is his understanding by
State statutes, section 7-7 that a five-day notice
should be given. The Town Attorney said that this
statute permits the Town Council to remove or add an
agenda item with a five-day notice. However,
cancellation of a meeting is different than adding or
removing an agenda item. We are also a chartered town,
section 7-7 refers to Selectmen.
Councilor Simon added that the house would be left on
tonight’s agenda.
Councilor Broxterman requested a projection of the
timeframe left in the cemetery. Acting Town Manager
Peter Souza said that we could give the town a better
projection.
Moved by Councilor Broxterman, seconded by Councilor
Dean to rescind the calling of the September 7, 2004
Special Town Meeting to consider an ordinance entitled
"The Sale of property on East Street in the amount of
$130,000" be rescinded.
Motion Passed 9-0-0
Mayor Trinks closed the Special Meeting at 7:17 p.m.
